Gkart – Privacy Policy

1. Platform Description

Gkart is an online Marketplace  that facilitates transactions between customers and independent local sellers located in Maduranthakam, Chengalpattu. Gkart does not own, manufacture, store, or directly sell products listed on the platform unless explicitly stated.

Gkart’s role is limited to providing technological infrastructure, order facilitation, and delivery coordination where applicable.

2. Eligibility & User Representation

* Users must be 18 years of age or older to place orders.

* By using the platform, users represent that all information provided is true, accurate, and complete.

* Gkart reserves the right to restrict access to users who provide false or misleading information.

3. Seller Onboarding & Approval

* All sellers must complete a registration process and are subject to Manual approval, particularly during the initial operational phase.

* Gkart reserves the right to approve, suspend, or terminate seller accounts without prior notice if policies are violated.

* Sellers are responsible for complying with all applicable laws, including licensing, taxation, and consumer protection regulations.

4. Product Listings & Pricing

Sellers are solely responsible for:

  * Product descriptions and images

  * Pricing and discounts

  * Stock availability

  * Quality, safety, and legality of products

* Gkart does not warrant the accuracy or completeness of seller-provided information.

* In the event of pricing or listing errors, Gkart reserves the right to cancel affected orders.

5. Orders & Payment Collection

* Gkart currently supports Cash on Delivery (COD) . 

Payment may be collected by:

  * Seller-authorised delivery personnel, or

  * Gkart-associated delivery personnel,

    Depending on the delivery method selected.

* All payments are collected on behalf of the seller, and Gkart does not assume ownership of transaction proceeds.

* Seller settlements are processed on a Customised settlement cycle as agreed with each seller.

6. Delivery Services

• Gkart operates a hybrid delivery model, 

wherein:

  * Some orders are fulfilled by sellers, and

  * Some orders are delivered using Gkart-supported logistics partners.

* Delivery timelines provided are estimates and may vary due to operational or external factors.

* Gkart shall not be held responsible for delays caused by sellers, customers, or unforeseen circumstances.

7. Returns, Refunds & Cancellations

* Return, refund, and cancellation policies are product-specific and seller-defined.

* Certain products may be non-returnable, including but not limited to:

  * Perishable goods

  * Hygiene and personal care items

  * Customised or made-to-order products

* Customers are advised to review applicable policies before placing an order.

* Refunds, where applicable, will be processed as per the seller’s policy within a reasonable timeframe.

8. Seller Obligations

Sellers shall be solely responsible for:

* Product quality and authenticity

* Packaging, dispatch, and compliance

* Managing returns and refunds

* Statutory compliance, including GST (if applicable)

Gkart shall not be a party to disputes between buyers and sellers.

9. User Conduct & Platform Usage

Users agree not to:

* Engage in fraudulent or abusive activities

* Misuse the platform or interfere with its operations

* Harass sellers, delivery personnel, or Gkart staff

* Violate any applicable laws or regulations

Gkart reserves the right to take appropriate action against violations.

10. Intellectual Property Rights

All intellectual property, including trademarks, logos, platform design, content, and software, are the exclusive property of Gkart. Unauthorized use or reproduction is strictly prohibited.

11. Limitation of Liability

To the maximum extent permitted by law, Gkart shall not be liable for:

* Product defects or quality issues

* Seller-related disputes

* Delivery delays or failures

* Indirect, incidental, or consequential damages

Use of the platform is at the user’s sole risk.

12. Suspension & Termination

Gkart reserves the right to suspend or permanently terminate user or seller accounts without prior notice in case of violation of these Terms or applicable laws.

 13. Amendments

Gkart may revise these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.

 14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Tamil Nadu.
